Emerson Lewis acts for both private and corporate lenders and borrowers with respect to all facets of banking and financial services.
Our services in these areas include:
- Advisory and transactional services for secured lenders, including advising in relation to regulatory and compliance issues and documenting and negotiating financial advances of all sizes;
- Providing advice in relation to recovery and realisation strategies to secured lenders with respect the recovery of their debts and the enforcement of their security interests, including through the appointment of receivers and managers or mortgagees in possession or otherwise in accordance with the Personal Property and Securities Act 2009 (Cth);
- Advising and acting on behalf of private and corporate clients in relation to debt and equity fundraising options including as part of transactions and negotiations with banks and other financial institutions;
- Representing private and corporate borrowers in disputes and litigation with banks, financiers and other financial institutions.
